Professional Biography
Michael joined Olenn & Penza in 1994, and has been a partner in the firm since 2001. Michael has tried many cases to verdict in both State and Federal Courts in Rhode Island defending professionals, municipalities, police officers, and insurance companies in a diverse variety of civil disputes, including catastrophic injuries, legal malpractice, civil rights violations, and personal injury litigation. In addition to his defense practice, Michael has recovered millions of dollars for hundreds of clients who have suffered personal injuries ranging from traumatic brain injuries to scarring and disfigurement.

Notable Experience and Recognition
Michael represented an individual who sustained permanent injuries after being struck by a drunk driver, recovering $1.5 million from the driver and the liquor establishment.
Michael recovered $1 million on behalf of a client injured in a slip and fall accident due to an accumulation of ice and snow. After suit was filed and extensive discovery completed, the case ultimately settled short of trial.
Michael recovered $750,000 for an on-duty police officer who suffered significant and permanent injuries after being struck by a drunk driver. After suing the driver and the liquor establishment, the case ultimately settled prior to trial.
Michael successfully represented a client who had suffered a spinal fracture as a result of a motor vehicle accident. The prior medical history of the client was significant for a prior spinal fracture. The insurer claimed that the surgery was not necessary and was related to the client's prior medical condition. Although the client's own treating surgeon was unwilling to assist with the case, Michael located and retained an expert neurosurgeon who determined that the client's condition was caused by the motor vehicle accident. The case was litigated and successfully resolved short of trial for $750,000.
Michael recovered $300,000 on behalf of an elderly individual who fell down a negligently maintained staircase. Because of the accident, the client had no recollection of the accident and there were no eyewitnesses. The case was referred to Michael from another attorney who was unable to procure a single settlement offer from the property's insurer. After litigating the case, the insurer paid the full amount of the insurance policy.
